No Felony Charges after Magistrate’s Hearing
Representing an individual at a Clerk-Magistrate’s Hearing on the charge of Larceny From Person, Attorney Riccio successfully argued the Application for Criminal Complaint lacked probable cause for the felony offense. Although the Magistrate suggested there was probable cause for a misdemeanor larceny charge, Attorney Riccio persuaded the court not to issue any criminal charges against his client.
In another Magistrate’s Hearing, Attorney Riccio represented a juvenile facing Negligent Operation charges after being involved in a two-car accident. Attorney Riccio argued there was no probable cause his client was driving negligently despite striking another vehicle. The Magistrate ruled in favor of Attorney Riccio’s client and declined to issue criminal charges.
Motion to Dismiss Allowed due to Police’s Failure to Issue Citation
Although this client had already been arraigned on charges of negligent operation and driving without a license, Attorney Riccio was hired shortly thereafter and filed a motion to dismiss based on law enforcement’s failure to issue a citation for the driving offenses. After a hearing involving officer testimony, the judge allowed Attorney Riccio’s motion to dismiss pursuant to the “No-Fix” statute.
